Effective date: October 23, 2026
These Terms of Service (the “Terms”) are an agreement between the user and Firebird Online Services Ltd. (“we,” “us,” or “our”) concerning access to or use of the HahaVPN apps, website, VPN service, help content, and related features (collectively, the “HahaVPN Service”).
Please read these Terms before using the HahaVPN Service. By downloading, accessing, or using the HahaVPN Service, the user agrees to these Terms and the HahaVPN Privacy Policy. If the user does not agree, the user must not use the HahaVPN Service.
1. Eligibility
Users must have the legal capacity to enter into these Terms under the law where they live. Users below the applicable age of majority may use the HahaVPN Service only with the consent and supervision of a parent or legal guardian. Any higher age requirement imposed by an app store or device platform also applies.
A user acting for an organization represents that the user has authority to accept these Terms for that organization.
2. The Service
HahaVPN is a consumer VPN service. Through VPN nodes managed by us, it establishes an encrypted connection between the user’s device and the selected node and forwards network traffic during the connection to destination internet services.
We may use infrastructure provided by data centers, server-hosting, cloud-computing, and network-connectivity providers. We remain responsible for the VPN service software, configuration, and operating policies. Use of third-party infrastructure does not make those providers operators of the HahaVPN Service or mean that we own all server hardware.
A VPN protects only part of the network path. It cannot guarantee complete anonymity or eliminate risks arising from malware, phishing, compromised accounts, unsafe websites, device vulnerabilities, or information the user voluntarily gives to third parties. Destination websites, apps, network services, and internet-access providers may continue to process user information under their own rules.
Available nodes, locations, protocols, speeds, capacity, and features may vary by platform, version, network conditions, security needs, or operational arrangements. Unless expressly agreed by us in writing, HahaVPN does not guarantee access to any particular website, app, content, or region, or circumvention of restrictions imposed by third parties.
3. Software License
Subject to compliance with these Terms, we grant the user a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the HahaVPN app solely for personal, non-commercial purposes.
Except as expressly permitted by applicable law or an applicable open-source license, users must not:
- copy, sell, rent, resell, sublicense, or commercially provide the HahaVPN Service;
- modify, decompile, disassemble, reverse engineer, or attempt to extract source code from proprietary parts of HahaVPN;
- remove or alter trademarks, copyright notices, or other rights notices in the app;
- use methods not provided or approved by us to circumvent service, security, or access controls; or
- impersonate HahaVPN, us, or our partners, or imply an unauthorized association or endorsement.
Open-source software included in HahaVPN is governed by its respective licenses. These Terms do not restrict rights expressly granted by those licenses.
4. Acceptable Use
Users must comply with the laws of their location, the place where the Service is used, and any other applicable jurisdiction, and are responsible for their activity through the HahaVPN Service. Users must not use, or help another person use, the HahaVPN Service to:
- engage in illegal, fraudulent, infringing, harassing, threatening, defamatory, privacy-invasive, or otherwise rights-violating activity;
- create, obtain, distribute, or promote content prohibited by law, including child sexual abuse material;
- access, scan, probe, control, or damage devices, accounts, systems, or networks without authorization;
- distribute malware, conduct denial-of-service attacks, or interfere with HahaVPN or third-party services;
- send spam, bulk unsolicited messages, phishing messages, or other unsolicited communications;
- distribute copyright-, trademark-, or other intellectual-property-protected material without permission;
- resell the Service, operate shared access, provide it as a public proxy exit, or use HahaVPN as a principal component of a competing service;
- unfairly consume resources through automation, high concurrency, or other abnormal methods that impair use by others; or
- circumvent reasonable measures used for security, abuse prevention, capacity management, or enforcement of these Terms.
5. Security Measures and Use Restrictions
To protect users, third parties, and the service network, we may use reasonable technical measures to prevent abuse, including restrictions on particular ports, protocols, destinations, abnormal traffic, or connection behavior. These measures may change based on security risks, hosting-network requirements, legal obligations, or service-quality needs.
We may restrict, suspend, or terminate access if we reasonably believe that use violates these Terms, harms the Service or others, may expose us to legal liability, or must be restricted to comply with a valid legal requirement. Where circumstances permit, measures will be proportionate to the risk; emergency, security, or legal reasons may prevent advance notice.
6. Availability and Changes
We will make reasonable efforts to maintain the HahaVPN Service, but the internet, device platforms, network providers, and infrastructure may fail or change. The Service may be interrupted, slowed, or unavailable because of maintenance, upgrades, security incidents, capacity limits, third-party failures, government action, natural disasters, or other events beyond reasonable control.
We may add, modify, or remove nodes, locations, app versions, and features. If we permanently discontinue the HahaVPN Service, we will provide advance notice through the website, app, or another appropriate channel where reasonably practicable.
7. Third-Party Services and App Stores
Third-party websites, apps, content, and services accessed through HahaVPN are outside our control and subject to their own terms and privacy policies. We do not endorse and are not responsible for third-party content, products, services, security, or availability.
Users who obtain the HahaVPN app through the Apple App Store, Google Play, or another distribution platform must also comply with the applicable platform terms. The platform distributes the app but does not operate the HahaVPN Service. To the extent required by platform rules, the platform may have applicable third-party beneficiary rights under these Terms.
8. Fees and Future Paid Services
The initial release of HahaVPN does not include paid subscriptions. These Terms do not authorize us to charge users without clearly presenting the price, billing period, automatic-renewal, cancellation, and refund rules and obtaining any required confirmation.
If paid plans are introduced, we will update these Terms or provide separate payment terms before charging users. Purchases through an app store are also subject to that store’s payment, cancellation, and refund rules. Account, subscription, device-limit, renewal, tax, refund, and termination rules must be published separately before paid plans are enabled.
9. Privacy
The HahaVPN Privacy Policy explains how we handle information and forms an important part of these Terms. Users should read it before using the HahaVPN Service and decide whether to accept the relevant VPN data notice when prompted in the app.
10. Intellectual Property
Except for applicable open-source software and third-party materials, intellectual-property rights in the HahaVPN apps, website, branding, graphics, text, interfaces, and related content belong to us or the applicable licensors. These Terms grant only the limited license in Section 3 and transfer no ownership.
We may use suggestions or feedback to improve the Service without identifying the user, unless the law requires otherwise or the parties agree otherwise in writing.
11. Disclaimers
To the maximum extent permitted by applicable law, the HahaVPN Service is provided “as is” and “as available.” We make no warranties not expressly stated in these Terms, including warranties of continuous availability, error-free or uninterrupted operation, any particular speed or node, fitness for a particular purpose, complete security or anonymity, or access to particular content.
Users are responsible for protecting their devices, accounts, credentials, and important data and for determining whether VPN use and internet access comply with local law. These Terms do not exclude any warranty or right that cannot lawfully be excluded under applicable consumer-protection law.
12. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, punitive, or consequential loss arising from use of or inability to use the HahaVPN Service, including loss of profit, revenue, business opportunity, goodwill, or data.
These Terms do not limit or exclude liability that cannot legally be limited or excluded, including liability for fraud, intentional misconduct, or death, personal injury, and consumer rights where applicable law prohibits limitation.
13. Stopping Use and Termination
Users may stop using the HahaVPN Service and uninstall the app at any time. Stopping use or uninstalling does not automatically delete information retained by the operating system, app store, or services used when the user voluntarily contacts support. See the Privacy Policy and applicable third-party rules.
Upon termination of these Terms, the user’s license to use proprietary HahaVPN software ends immediately. Provisions that by their nature should survive, including intellectual-property, disclaimer, limitation-of-liability, and dispute provisions, remain effective after termination.
14. Changes to These Terms
We may update these Terms due to changes in the Service, law, security, or operations. Updated Terms will state their effective date. For changes that materially affect user rights or obligations, we will, where reasonably practicable and legally required, provide advance notice through the website, app, or another appropriate channel. Users who do not agree to updated Terms must stop using the HahaVPN Service.
15. Governing Law and Disputes
Without depriving users of rights under mandatory consumer-protection laws where they live, these Terms are governed by the laws of the British Virgin Islands. The parties should first attempt in good faith to resolve disputes through the contact channels in these Terms. The courts of the British Virgin Islands have non-exclusive jurisdiction over related disputes, and users may still bring claims in any other court permitted by applicable mandatory consumer-protection law.
16. General Terms
If any part of these Terms is held invalid or unenforceable by a competent authority, it will be modified or severed only to the minimum extent necessary, and the remainder will remain effective.
Our failure to immediately enforce a right is not a waiver. Users may not assign rights or obligations under these Terms without our written consent. We may lawfully assign these Terms in connection with a merger, reorganization, or business transfer and will provide any notice required by applicable law.
These Terms, the Privacy Policy, and any other rules expressly incorporated form the entire agreement concerning the HahaVPN Service. If different language versions conflict, the English version controls, except where applicable law mandatorily provides otherwise.
